PRACTICE AREA

Contentious Trusts

We have significant experience across a broad spectrum of contentious (and non-contentious) matters relating to trusts (and foundations). We act for settlors, trustees, protectors and beneficiaries and as court-appointed guardian ad litem representing minor and unborn beneficiaries.

We use our experience and expertise to assist with the resolution of issues arising in the context of trusts outside of the court process, including through mediation. Where such a resolution is not possible or is not appropriate, we have considerable experience of the Court process, both in relation to administrative and hostile proceedings. We have advised on, and appeared in, some of the leading Jersey cases in relation to trusts and foundations.

We have experience in:

  • Breach of trust proceedings – both bringing and defending actions
  • Trustee blessing applications
  • Proceedings seeking the removal of trustees and protectors
  • Beddoe applications
  • Mistake and rectification applications
  • Variation applications
  • Proceedings relation to the provision of information and disclosure by trustees, including to tax authorities
Danny Le Maistre can grasp complex matters quickly and ensured we remained focussed on the end goal.
